Terms of service
These terms govern your use of the Observo Labs console and API at app.observolabs.com (the “service”), operated by [Operating legal entity and registered address: to be completed by the owner] (“we”, “us”). By creating an account or using the service you agree to them. If you use the service for an organization, you confirm you may bind it. Our privacy policy explains how we handle data.
The service#
Observo Labs lets you submit machine-learning jobs (for example training, evaluation and data preparation) through a web console or API, follow their progress, store and download their results, and pay for compute with prepaid credits. Some job types may not be available at all times, and compute for jobs is provided through third-party infrastructure providers.
Accounts and API keys#
- You must be at least 18 years old. Give accurate information and keep your sign-in credentials secure.
- Accounts belong to an organization. Organization admins can create and revoke API keys and buy credits; members can run jobs.
- An API key is shown once and acts with the role it was created with. Keep it secret. You are responsible for everything done with your accounts and keys, including spend. Revoke a key if you think it has leaked.
- Keys created by a person stop working if that person is removed from the organization or their account is disabled.
Prepaid credits and payment#
- You pay for the service with prepaid credits, bought in packs of $25, $100 or $500 (US dollars) through Stripe. One credit is one US dollar of the pack’s price before any tax. Payment card details are handled only by Stripe.
- Credits do not expire.
- When you submit a job we reserve an amount from your balance based on the maximum runtime you set. When the job ends we settle to the actual cost and release the rest. A job is refused if your balance does not cover the reservation. If we cannot tell how a job ended, its reserved amount may stay charged until it is resolved.
- Uploading files requires a positive credit balance.
- Purchases are non-refundable except where the law requires a refund or we decide to give one. If a payment is refunded or successfully disputed, we remove the matching credits (in proportion to the amount refunded; tax is never credited and so never removed). If you have already used them, your balance can go negative: new jobs and uploads are refused, your next purchase first repays the shortfall, queued jobs that are no longer covered may be cancelled (newest first), and jobs already running continue and are settled.
- Prices and the rates charged for job types may change; changes do not alter a reservation already made.
Acceptable use#
You agree not to:
- use the service for anything illegal, or to store or process content you have no right to use or that is unlawful;
- attack, probe, disrupt or overload the service or other customers, or try to access another organization’s data;
- circumvent or interfere with rate limits, quotas, spending limits, credit checks or other safeguards;
- share accounts or keys in ways that hide who is responsible, or resell access without our written agreement;
- use the service in violation of the terms of the providers that supply it (for example Stripe, Modal, Cloudflare and Clerk).
Your content#
You own the data, models, code and files you submit and the results your jobs produce (“your content”). You grant us a limited licence to host, copy, process and transmit your content, and to share it with our infrastructure providers, only as needed to operate, secure and bill for the service and to provide it to you. This licence ends when your content is deleted from our systems, subject to the retention described in the privacy policy. You are responsible for your content and for having the rights and permissions to use it.
Beta service, no warranty#
The service is in beta. It is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows. We do not promise that it will be uninterrupted, error-free or secure, that jobs will complete, or that results will be accurate. We do not promise any uptime or data-retention period. Keep your own copies of anything you need.
Limitation of liability#
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and $100. Nothing in these terms limits liability that cannot be limited by law.
Suspension and termination#
You may stop using the service at any time. We may suspend or end access, revoke API keys, disable accounts or organizations, or cancel queued jobs if you break these terms, if we reasonably think the service or other customers are at risk, if a payment is reversed, or if we must by law. We may also stop offering the service; if so we will try to give notice. Sections that by their nature should survive (such as payment obligations, liability and governing law) survive termination.
Changes#
We may change these terms. The date and version at the top show the latest change. For significant changes we will take reasonable steps to tell account holders. Using the service after a change takes effect means you accept it.
